    Terms of Use

    1. Who we are and acceptance of these Terms

    These Terms of Use ("Terms") govern your access to and use of the Aeza platform, including our website, mobile application and related services (together, the "Service"), operated by Aeza Innovations Private Limited, a company incorporated in India with CIN U63122AP2025PTC120051 and registered office at H No. 26/9/419/26-3, Revenue Ward No. 26-III, Bhaktavatsalanagar, Nellore 524003, Andhra Pradesh ("Aeza", "we", "us" or "our").

    By creating an account, clicking to accept, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

    2. Eligibility

    The Service is available only to individuals who are 18 years of age or older and capable of entering into a legally binding contract under the Indian Contract Act, 1872. By using the Service you represent that you meet these requirements. We do not knowingly permit use of the Service by persons under 18, and we may suspend or delete accounts we reasonably believe belong to minors.

    3. Private beta status

    The Service is currently offered as a private beta. You acknowledge and agree that:

    • the Service is a pre-release version provided for evaluation and feedback, and may contain errors, defects and incomplete features;
    • features may be added, changed, suspended or removed at any time without notice;
    • we do not guarantee any uptime, availability, support or service levels during the beta;
    • we may limit, suspend or revoke beta access at any time, at our discretion, with or without cause;
    • data, content, preferences, renders and other material created or stored during the beta may be modified, reset or permanently deleted at the end of the beta period or during migration to a general release, and we are not obliged to preserve or export it; and
    • the beta is provided free of charge, and no feature demonstrated during the beta is a commitment that the same feature will be available, or available on the same terms, in any general release.

    4. Your account

    You must provide accurate, current and complete information when registering and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at ayush.shetty@aeza.in of any unauthorised use. Accounts are personal to you and may not be shared, sold or transferred. Beta invitations and invite codes are non-transferable unless we state otherwise.

    5. The Service

    Aeza is an AI-powered styling and shopping discovery platform. Depending on the features enabled for your account, the Service may allow you to receive personalised product and outfit recommendations, generate virtual try-on visualisations using photographs you upload, receive size and fit suggestions based on measurements you provide, and discover products from third-party brands and retailers.

    During the beta, Aeza does not sell products, process payments or fulfil orders. Product listings may link to third-party brand or retailer websites. Any purchase you make is made directly with that third party, on that third party's terms, and Aeza is not a party to, and has no responsibility for, that transaction, including pricing, availability, delivery, quality, returns or refunds.

    6. AI-generated content

    Recommendations, styling suggestions, size and fit guidance and virtual try-on visualisations are generated by artificial intelligence systems. They are provided for informational and entertainment purposes only. AI outputs may be inaccurate, incomplete or unsuitable for you. In particular:

    • try-on visualisations are simulated renders and are not exact depictions of how a garment will look, fit or drape on your body;
    • size recommendations are estimates and do not guarantee fit; and
    • product information (including price and availability) is sourced from third parties and may be out of date.

    You should exercise your own judgment before relying on any output of the Service, including before making any purchase from a third party.

    7. Your content and licence to us

    "User Content" means content you submit to the Service, including photographs, body measurements, style preferences, ratings and feedback. You retain ownership of your User Content. You grant Aeza a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt and display your User Content solely to the extent necessary to operate, provide, secure and improve the Service and as further described in our Privacy Policy and the consents you give. Processing of photographs and body measurements is subject to the specific consents described in our Privacy Policy and Consent Notice.

    You represent and warrant that: (a) you own or have all rights necessary to submit your User Content; (b) any photograph you upload for virtual try-on depicts you and only you, and you will not upload photographs of any other person without that person's explicit, informed consent; and (c) your User Content does not violate any law or any third party's rights.

    We may remove or disable access to any User Content that we reasonably believe violates these Terms or applicable law.

    8. Feedback

    The beta exists to gather feedback. If you provide suggestions, ideas, bug reports or other feedback about the Service ("Feedback"), you assign to Aeza all rights in that Feedback, and we may use it for any purpose without restriction, attribution or compensation. Feedback does not include your personal data, which remains governed by our Privacy Policy.

    9. Acceptable use

    You agree not to, and not to attempt to:

    • use the Service for any unlawful purpose or in violation of these Terms;
    • upload photographs of any person other than yourself without their explicit consent, or any content that is unlawful, obscene, defamatory or infringing;
    • scrape, crawl, harvest or extract data from the Service, or use any automated means to access it, except as we expressly permit in writing;
    • reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, models, prompts, weights or architecture of the Service, except to the extent such restriction is prohibited by law;
    • use the Service or any output of it to build, train or improve a competing product or service, or for benchmarking or competitive analysis, without our prior written consent;
    • interfere with or disrupt the integrity or performance of the Service, probe or test its vulnerability, or circumvent any access or rate limits;
    • misrepresent your identity or affiliation, or share, sell or transfer beta access or invite codes without our permission; or
    • use the Service to harass, harm or violate the rights (including privacy and publicity rights) of any person.

    10. Intellectual property

    The Service, including its software, models, design, text, graphics, logos and trade marks, is owned by Aeza or its licensors and is protected by intellectual property laws. Except for the limited right to access and use the Service in accordance with these Terms, no rights are granted to you. Brand names, product images and trade marks of third-party brands displayed on the Service belong to their respective owners; their appearance does not imply endorsement of Aeza by those brands or of those brands by Aeza.

    Virtual try-on renders generated from your photographs are provided for your personal, non-commercial use. You may save and share your own renders, subject to Section 13 (Sharing during beta).

    11. Third-party services and links

    The Service may contain links to, or integrate with, third-party websites, brands, retailers and services. We do not control and are not responsible for third-party content, products, services, terms or privacy practices. Your use of third-party services is at your own risk and subject to their terms.

    12. Privacy

    Our collection and use of personal data, including photographs and body measurements, is described in our Privacy Policy and Consent Notice, available at aeza.in and in the app. Please read them carefully.

    13. Sharing during beta

    We encourage you to share your beta experience publicly, including screenshots, screen recordings and your own try-on renders. You must not publicly disclose: (a) personal data or renders of any other user; (b) non-public information we share with you privately, such as roadmaps, internal metrics or unannounced pricing; (c) security vulnerabilities, which should instead be reported privately to ayush.shetty@aeza.in; or (d) information we identify to you in writing as confidential. If you have signed a separate Beta Tester Agreement, that agreement governs in the event of a conflict with this Section.

    14. Disclaimers

    To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that defects will be corrected, or that any recommendation, render or size suggestion will be accurate or suitable for you. Nothing in these Terms excludes any right or remedy that cannot be excluded under applicable law.

    15. Limitation of liability

    To the maximum extent permitted by applicable law: (a) Aeza and its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data or content, arising out of or in connection with the Service or these Terms, even if advised of the possibility of such damages; and (b) Aeza's total aggregate liability for all claims arising out of or in connection with the Service or these Terms will not exceed the greater of (i) INR 1,000 (Indian Rupees one thousand) and (ii) the amounts (if any) paid by you to Aeza for the Service in the 12 months preceding the event giving rise to the claim.

    Nothing in these Terms limits or excludes liability for fraud, wilful misconduct, or any other liability that cannot be limited or excluded under applicable law.

    16. Indemnity

    You agree to indemnify and hold harmless Aeza and its directors, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your User Content, including any photograph uploaded without the necessary consent; or (c) your violation of any law or the rights of any third party.

    17. Suspension and termination

    You may stop using the Service and request deletion of your account at any time through the Service or by writing to ayush.shetty@aeza.in. We may suspend or terminate your access to the Service at any time, with or without notice, including if we reasonably believe you have breached these Terms, if required by law, or upon conclusion of the beta programme. Upon termination, Sections 7 (licence, to the extent needed to wind down), 8, 10, 13, 14, 15, 16, 19, 20 and 21 survive. Deletion of personal data following termination is governed by our Privacy Policy and applicable law.

    18. Changes to the Service or these Terms

    We may modify these Terms from time to time. If we make material changes, we will notify you through the Service or by email and indicate the "Last updated" date above. Changes take effect on the date stated in the notice. Your continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

    19. Governing law and dispute resolution

    These Terms are governed by the laws of India. Subject to any mandatory rights you may have under applicable law, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service. Before initiating proceedings, the parties will attempt in good faith to resolve any dispute through the grievance process in Section 20.

    In accordance with the Information Technology Act, 2000, the rules made under it, and the Digital Personal Data Protection Act, 2023, our Grievance Officer is:

    We will acknowledge complaints within 24 hours and endeavour to resolve them within 15 days of receipt, or within such other period as applicable law requires. Details of the process appear in our Grievance Redressal Notice.

    21. General

    These Terms, together with the Privacy Policy, Consent Notice, Cookie Notice and any Beta Tester Agreement you accept, constitute the entire agreement between you and Aeza regarding the Service. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets, subject to applicable data protection law. Notices to you may be given through the Service or to the email address on your account; notices to us should be sent to ayush.shetty@aeza.in or our registered office.
